Local Waste Payments

I started writing this in October 2011. I didn't have all of the supporting documents loaded so I never posted it. This is the company that "we are keeping the village with". They did NOT have the lowest bid from what I remember back then, and they were invoicing us for more than the contract rate back in 2010 and 2011. Please read:


There have been some discussions about the payments made to Local Waste Services. There is a discrepancy between the contract rate, the rate charged to us by Local Waste on their invoices, and the rate at which the [Acting] Fiscal Officer (previously Clerk-Treasurer) has paid LWS.

The contract for Local Waste Services is active from the 1st day of September 2010 to August 31st, 2013.

The contract rate above is $14.40 per unit for 564 houses with a total of $8,121.60 per month.

The following is a register of the payments made to LWS in the first half of 2011.


An amount other than the contract rate comes up in the following payments:
6/16/10       $8,232.00
6/30/10       $8,232.00
8/16/10       $8,232.00

Then a different amount was paid between September-December:
9/21/10       $8,064.00
10/11/10     $8,064.00
11/15/10     $8,064.00
12/13/10     $8,064.00

New numbers again:
1/31/11       $8,209.60
2/23/11       $8,033.60
3/14/11       $8,121.60   (finally, the contract rate!)

The origin of these numbers is a bit confusing, but we'll work it out slowly.

At present I do not know why they were charging $8,232.00. The document distributed by Local Waste at the September 2011 Council Meeting shows a fluctuation in the per unit rate. More on this document below.

The $8,064.00 is based on our contract rate of $14.40/unit but only counting 560 units.

January's invoice was higher than the contract rate because LWS passed on a $145.60 dumping fee. There is no allowance for this fee in our contract. There is a statement for including a monthly fuel surcharge however this is to be based on the Federal Bureau of Labor Statistics cost of living index for Columbus, Ohio. There is no such thing.

Things get really complicated when you start looking at what LWS thinks about these numbers:

Their argument in passing on that landfill dumping fee was that "it doesn't say that we can't" in the contract.

  1. If a representative from Local Waste Services reasoning was "it doesn't say that we can't" in the contract in trying to pass on an increase in landfill dumping fees, what will residents be subjected to about any similar things?
