Another Trash Ordinance, and Another Emergency

Well, they're at it again.

The following legisilation will be before council at the upcoming meeting, Monday, April 8th. (Starts at 7pm)
It is already outlined to have the three readings waived, and to be passed, as an emergency, on the 8th.





































































Most abrasive are these portions of the ordinance:
"No firm or corporation other than the Village or its authorized agent who holds a lawful contract with this Municipality shall collect, remove or transport garbage or refuse from single family residences within the Municipality."

and 


"(a)    Whoever violates Section 1060.02 or pleas to a violation of Section 1060.02, or is convicted of a violation of Section 1060.02 shall be fined not more than fifty dollars ($50.00).  Each day’s continued violation shall constitute a separate offense. 

(b)   If a firm violates Section 1060.03 or enters a plea to a violation thereof, or who is found to be guilty of violation thereof shall be guilty of a misdemeanor of the first degree and fined not more than one thousand dollars ($1,000)." 


In other words, even though they just passed a resolution that you'll be the one paying for services, you can't elect to use another service for trash collection. Well, you can, it's just illegal in Minerva Park now, and you will be subject to a fine.

They defend being able to do this with ORC 715.43.
The ORC Section 715.43 says this:
"Any municipal corporation may provide for the collection and disposition of sewage, garbage, ashes, animal and vegetable refuse, dead animals, and animal offal, and may establish, maintain, and regulate plants for the disposal thereof.
Effective Date: 10-01-1953"

"Provide for"....does that include requiring residents not only pay for refuse collection but also that they pay the entity that Minerva Park chooses? It seems that is the way MP officials have interpreted it. History shows, however, that that MP officials interpret isn't always correct. In my experience, it is incorrect more often than not....but nobody does anything about it, so it doesn't matter. They have free rule over this village and nobody tries to stop them for very long. Now's the time to get involved. 

Now that they are requiring residents to pay out of pocket for something that used to come from our taxes, people are starting to pay more attention.

By the way, if you're one of the many calling Local Waste asking them why you're required to pay now and when your credit from your taxes is going to come back to you....it's not. Don't ask them, ask the Mayor and Council, preferably in these "open meetings" they claim to be having.

  1. The thing I don't understand about this piece of legislation is why the Village has to make every home owner or renter subscribe to the Village's approved trash co.

    I have two neighbors who don't put trash out. One lady lives with her sister and comes to her house to get her mail. She hasn't put trash at the curb for the 5 years I've lived here. The other lady has moved to Friendship Village and is trying to sell her house. Why should these 2 retired senior citizens have to pay for a service they don't use.

    It seems to me that there ought to be another way for the Village to get out of paying for trash collection other than making people pay for something the don't use.

    There are people who could very easily get rid of the trash they generate on there own.I used to go to my mothers house and instead of walking her trash all the way to the apartment dumpster I put it in my car and toke it to work and threw it away.

    I understand why the Village wants to limit the number of trucks coming through the Village, but to make people pay for something that they don,t need is wrong!!!

    1. Getting rid of your trash on your own by taking it to mommy's house or work is theft of services and it is a crime.

    4. It's not a crime to take your trash to work if you pay for the trash service where you work or have permission from the person who pays for it.

  2. So, should we expect for there to be 0 salary increases or any other benefit to any of then officials? Since, according to them, they don't even have enough money to pay for trash collection.

    I could care less if I had to pay for trash services, but my taxes better drop if my taxes are not covering it.

    I think it is ridiculous as well that people will be charged for trash pickup if they don't use the service.

    Is the Minerva Park community building being billed for trash pickup as well?

  4. I wouldn't attribute any village goings on to conspiracy. This is straight up Hanlon's Razor: Never attribute to malice that which is adequately explained by stupidity.

I am sure some pay increases have happened for some village employees just as the employees that receive full medical, dentail, and vision were also given the full amount of their had their deductible, and this does include the mayor. Do you really think that not having money to pay for trash would stop that? You really need to remember that the 2013 budget is FIVE years in a row of budgets with Expenditures Greater than Revenues.

  6. It is Time to down size and it needs to start with council lowering the the pay for the mayor to a part time wage and part time benefits. Council needs to do something! I would like someone to tell me what the mayor and council have done> this year and the years in the past.NOTHING TO MAKE THE VILLAGE IMPROVE! Tony and Suzanne Have been telling the council and the mayor that they were running out of money for years! and nothing has been done.
    Now the safety levy that is soon to come. The mayor was asked about this at the last election.She new nothing about it. They have talking about for awhile. And if you her she will bat her eyes and say i don't recall.
